The commanding officer of the Bluff Naval Artillery sued John Hunter a former member, to recover his uniform or its value, to T gether with JB2 damages for detention. The Court ruled it had no jurisdiction, as particular punishment was provided for by the Defence Act for refusing to deliver such articles, and there was jno alternative. A civil remedy was avoided by making it a criminal offence for a volunteer to retain such articles on quitting the force. The Legislature had taken away the option of the commanding officer to sue civilhy. Plaintiff was nonsuited with costs. - ■ ■ ■
