(Per Press Association.) Wellington, This Day. In the Appeal Court argument is being heard in the case of Sanitas Company v. Ogle, of Auckland (manufacturer of pumice soap, etc.) In this action, which is an appeal from Judge Conolly, the appellant seeks to restrain the respondent from using the word " Sanitas," as an infringement of its trade mark. In tEe previous case Judge Conolly held that the use of the word by respondent was not calculated to deceive the public, and gave judgment for respondent.
