An Interesting Claim.
[Per Press Association. 1 Wellington, February 14. In the Supreme Court the special case, George Anderson v. trustees of estate of the late Mr W. H. Levin was before Mi^Justice Eichmond this morning. In th^v statement of claim it is alleged that plain* tiff entered the service of Levin and Co. in 1861 and remained in it until 1893, his position being chief storatnan. On various occasions Mr Levin had promised to give him a pension. On the 16th of August, 1693. Mr Levin gave his bookkeeper a memorandum that plaintiff would retire on the Ist September on half pay — viz. £125 a year, Subsequently Mr Levin agreed to pay plaintiff £150 per annum. Mr Levin intended in his will toprovide lor the carrying out of the promise, but died without having done bo. The pension of .£125 was paid from ls,t September, 1893, until Mr Levin's death. Plaintiff now prayed that the promise in question might be declared binding upon the defendants as trustees and executors, and that they be ordered to pay him the sum of iJl2a a year during his lifetime, Jn alternative, he prayed for judgment for 42000. Mr Bell for the defendants said the question was whether the obligation was on tbo family or upon the trustee?, or whether it was a legal obligation. There was no question of stopping payment to the plaintiff The point was raised by the trustees, who would bo satislied if the Court found there was -legal obligation upon them to pay the money.
