IN THE ESTATE OF T. M. JACKSON.
A meeting of creditors in the bankrupt estate of T. M. Jackson, butcher, of Birmingham, who waß ajudicated bankrupt on the petition of J. Maginnity and Co., on December 6th last, was held at the Feilding Courthouse yesterday afternoon. Mr G. J. Scott, D.0.A., pre« sided. The creditors present or repre* sented were —P. Murphy (with his solicitor, Mr Richmond) JI21; L. E. Reade, .£3 9s Qd ; Kirton and Curtis, £5 16s; H. Axnp, 16s; H. S. Fitzherbsrt, £00. The debtor, with his solicitor, Mr H. S. Fitzherbert, was also present. The list of liabilities filed was as follows:—J. Maginnity Ll7O 4s sd, P. Murphy L2l, W. T. L. Travers L 24, F. S. Guy Ll9 10s, Dudgeon LB, Berry and Co. L 7 18s 4d, Kirton and Curtis L 5 16s, L.E. Reade L 3 9s 9d, E. Sandeman L 5 ss, H. Axup 16s, Chamberlain Bros. L 8 7s Id, Christchurch Press Co. L 2 17s lOd, Davy and Mills LI 15s, A. H. Tompkins L 4, R. Hammond L2O, H. S. Fitzherbert L3O; Total, L 327 19s sd. The only assets were book debts amounting to L6OO, estimated to pro* duce LBOO. Mr R. Burne put in a claim for L 75, but Mr Fitzherbert objected on tht> ground that they did not know what amount was due to Mr Burne. The amount claimed was an award by the District Court on Monday last, ana the fourteen days allowed for appeal had not yet expired. The debtor did not admit the claim as being correct. He contended that in reality Mr Burne owed Jackson £20 or £30. On the recommendation of the D.0.A., Mr Burne withdrew his claim for the present. In reply to the D.0.A., debtor said : The books in connection with bis Wei* lington business were in the hands of Messrs Cook and Gray, who were col* lecting the accounts : they had the books for twelve months, and had only accounted to him for L 5 or L 6; these debts were five and six years old ; he and Warner bought a butchery business at Birmingham in June, 1893 ; he had no capital at the time; worked on borrowed capital ; obtained money by getting friends to endorse bills, which the banks discounted ; leased the horses, plant, etc., when he took over the business ; the books he had at Birmingham had been handed over to Mr Guy, to whom the business had been assigqed. iv April last. To Mr Richmond ; The business wa.s leased by Warner and himself from Sir Burne at 30s a week } the partnership was carried on till February, 1894; paid Warner to go out of the business; in February last Burne distrained for L 54, and in March sued him for L6O, but was non -suited ; it was this that put debtor in a hole; carried on business since April 6th for Mr Guy, who was paying him LI a week and 10 per cent commission on cash taken ; everything was made over to Mr Guy ; the transaction with Maginnity happened through debtor backing an hotel business in Wellington about four or five years ago ; thought the affair had been dropped until he was sued by Maginnity a few months ago* To Mr Reade : Had it not been for the illegal distraint in February last would not have been in his present position. To the D.0.A. : His debts in May last, when he was adjudicated bankrupt (but which was annulled), were stated at LB4 15s fid ; Fitzherbert's and Trarers* accounts had been contracted singe than; Hammond's account was ace.ii dentally omitted ; had been purchasing stock in his own name for Mr Guy; told Mr Carr and others how he stood ; all accounts were sent out as "Jackson and Co." Proposed by Mr Reade, secouded by Mr Richmond (as proxy for Mr Murphy) That tho matter of dealing with the estate be left in the hands of the D.O.A. to settle at once ; and that the debtor's order for an immediate discharge fee recommended.— Carried. This, was all the business and the meeting adjourued.
