(Per Press Association.) Wbllinotom, Norember 18. The Appeal Court gave judgment to day on the petition of the Commissione: of Taxes in re Jno. Chambers, deceased The Court was of opinion the transac tion involved ought not to be treated a: a mere scheme to evade payment of dv ties under the Deceased Persons Estatei Duties Act, 1881, but they held unani mously deeds of conveyance and coven ant were liable to duty as deeds of gif under the Act of 1885. Costs were al lowed to the Commissioner on the high est scale. Melbophnk, NoTtmbrr 13. An important decision has bee n giver by the court. The question was whethei calls on shares in estates of deceased persons that might become due should be regarded as debts and be exempt from probate duty. The Court held thai shares and deposit receipts should b« taken at market value and not on the face values, and calls payable should be treated as debts. Judgment was therefore entered up in favour of the executor.
