Local Bodies' Responsibility.
(Per Press Association). Masteeton, March 30. A case of considerable importance to local bodies was decided in the District Court ou Thursday. W. R. Coe, carrier, of Puhiatua, claimed from the Pahiatua County Council the sum of £41, as damages sustained through the road in the Makuri Gorge having slipped away, and his horse having been precipitated down the ravine, with the result that it was killed. It was shown in the evidence that the Council had numerous extra hands employed at the time clearing away slips, And that its officers were not aware of the slip in question before the accident occurred. The jury found that the defendant Council did not negligently allow the slip to remain on tho road, and that the rider of the horse did not exercise proper care. Judgment was therefore given fur the defendants, with cost 9. During the hearing of the case, District Judge Kettle drew attention to the confusion and muddle of the law, and pointed out that learned Judges had frequently urged the Legislature to define the responsibilities and liabilities of local bodies. He hoped the local bodies of this district would combine to make representations regarding the necessity of properly defining their position.
