Feilding R.M. Court
THIS DAY. (Before Mr Brabant, 8.M.) It. Parr v.Wm. Baker. Mr Reade for plaintiff, and Mr Sandilands for defendant. Iv this case the solicitor for the defendant applied for a rehearing of the case, judgment having been given ' against him. Mr Reade opposed the re-heanng. His Worship, on hearing counsel, granted a rehearing, and the case was adjourned to next Court day, March 15th. Judgment was given in the case, 0. Millen y. F. Pope, heard last Court day. His Worship reviewed the case, and stated that plaintiff had let the house to Boyd, and not the land, and therefore could not distrain' the cattle. The plaintiff would be non-suited with costs 3s, solicitor's fee £2 2s, and witness' expenses 7s. E. Cornwall v. W. C. Boyd ; a judgment summons, claim £16 10s. Mr Richmond fdr plaintiff. W. C. Boyd was examined by Mr Richmond, and His Worship asked witness a number of questions about his financial position and as to his ability to pay. D. Millen was also examined. His Worship considered this was a case in which an order could not be made. J. J. Bryce v. J. W. D. Theobald j a judgment summons, claim £9 14s. Mr Richmond for plaintiff, and Mr Sandilands for defendant. Defendant was examined as to his ability to pay. His Worship could not make any order on the evidence. . Ellen Boyd laid an information against he; husband, for desertion and / leaving her and four childreu destitute. Mr Prior for complainant. Caroline Boyd and Constable Tuohy gave evidence for the complainant, and J. Marshall and E. Cornwall for defendant. Defendant was ordered to pay 15s a week towards the support of his wife and four children, the first payment to be made this day week. (Left sitting.)
