Feilding Stipendiary Court
-'-.;- :y: (Before Mr. Brabant, S.M.) The following cases were heard after we went to ress on Thursday last :— Arthur Dernier v. P. Garrity, claim £1 ss. Mr Prior for the plaintiff, Mr Baker for the defendant. The claim was for serving fivs cows at five shillings each, Tbe evidence in this ease was very lengthy, the plaintiff being examined and crossexamined very fully aa to the terms of his agreement with Garrity. Messrs C. Dermer, Botiess, Toss will, and Purkiss, were also called for the plaintiff. Masare P. Garrity, H. Desmond, J. Knight, Fairfield Thompson, Alexander Robinson, B. Whisker, and James Mnnro, ' gave evidence for the defence. His Worship said there was very little evidence-ad-duced as to the inefficiency of the bull. Thompson's evidence -was in favor of the plaintiff on this point, The evidence of Toßswill and others was to the effect that arrangement was made to pay the fee at the time of service. No distinct custom has been proved in the evidence, but what bns been adduced is strongly in favour of the plaintiff. Judgment would be for the plaintiff, for the amount claimed, with 6s costs of court, and 28s witnesses' expenses. J. H. Tartalini v. J. J. Hines, claim £12 10s nnder a judgment summons. Mr Esam for the plain'iff, Mr Beade for defendant. His Worship made an order for defendant to pay the amount by monthly instalments of £1, the first pay* ment to be made on tbe Ist of August. B. Richardson v. Louisa Dunne, claim £4t 10s. Mr Sandilands for Ihe plaintiff, Mr Hankins for the defendant. Robert Richardson deposed that the amount was clue to him for work done on the late Mr Clarke Dunne's property at Kiwitea.. Messrs Geo. Richardson, Joseph Borne, and Samuel Cossey, were called for the plaintiffs case. Mr Hankins, for the defence, deposed that tbe claim should have been sent in some months -ago, aa the estate "had since been wound up and the proceeds thereof --paid over to the next-of-kin, who resitted in England. Again, the defendant never authorised George Richardson to employ labor in looking after the estate. Mr G* N. Wood deposed that be was a brother of the defendant, and on her husband's death, wtmess gave George Richardson orders not to employ any labour on the estate, and uever authorised the plaintiff's being engaged. Mr Sandilands submitted that all the witnesses testified that his client was working on the estate. His Worship said he thought the plaintiff had failed to make out bis case ; there was no authority for tbe witness, George Richardson, to engage hands, and the plaintiff would be noo.-sn.ited. Thomas Hall v. F. J. Hedge, claim. £6 15s — value of a cow sold by the defendant, which the plaintiff alleged . had to be slaughtered, on account of its suffering from tuberculosis. Mr Sandilands for the plaintiff, Mr Prior for the defendant. Mr A. K. Blundell, stock inspector, deposed that on the Ist of Slay be ordered the cow in question to be slaughtered, as it was' suffering from tuberculosis. By Mr Prior : Witness did not give written instructions with reference to the destruction of the cow. H* had been an inspector of stock for 18 yean past in various parts of tbe colony. He only gave a written order for the de* struction of stock when the animal was exhibited in a sale yard ; re-examined, he bad no donbt the cow' was suffering from tuberculosis and that it would be dan. gerous to use the milk. Tbe farther hearing of this case was adjourned to the 29th inst. Darcy Show and John Francis v. Alfred Goldfinch, claim £17 lis 4d due on a bushfelling contract. Mr Sandilands for the plaintiffs, Mr Hankins for the defendant. The plaintiffs gave evidence as to tbe terms of the contract. Mr Sandilands asked for the production of the signed contract. Mr Hankins objected to its being put in evidence as it was in* sufficiently stamped, . and counsel de* mended that the £5 fine be first paid. His Worship agreed to make a note of Mr Hankin'a objection, and at this stage adjourned the further hearing of the case till the 29th inst. The Court then rose, it being 9.80. pan.
