He held first that the Board's action was illegal and ultra vires ; secondly that Mr McLauchlan, the schoolmaster, was entitled to retain his position until removal or suspended, as provided by the Act ; thirdly, that the Board was restrained from preventing Mr McLauchlan enjoying the emoluments and benefits attached to his office; fourthly, that an order be made for 12 guineas costs together with disbursements. _
