M. had carefully looked into the matter, and was of opinion tfi'e action was properly brought. The. possession was in Mr Rees, and still remained so, as he had a claim on the chattel for work done. He held the chattel even against Mr Scott, the Assignee; ;-He'(the R.M.) was asked to say the property was that of the plaintiff, as she had bought it with money earned by herself. The bankruptcy of plaintiff's husband occurred two years after the chattel was purchased. Judgment for plaintiff for LI 7, the claim for damages not being allowed. An order was made for the return of the vehicle with costs of action 51s. . ■;•"• Hastie t. Marshall and Copeland.— Claim L3O ss. Mr Staite, with him Mr Sandiiands, for plaintiff, and Mr Hankins for defendants. This was an action to recover the. value of 4 hogsheads of ale, X18 ; costs and damages, Ll2 ss. The beer was alleged to have "gone bad," and been rejected. ■ James Hastie deposed : He was a publican residing in Feildmg ; knew the firm of Marshall and Copeland ; bought 4 hogsheads o£ beer from the traveller of the firm (Mr Turner) at L 4 10s each about November, 1886 ; kept the beer in the cellar 2 months before it was tapped; the customers complained of its quality, and refused to drink it ; then wrote to vendors complaining of the quality of the beer ; when Turner came gave him a p.n. dated March Ist; the letter was written on the 30th ; Turner sampled the beer at Feilding; took the hogsheads out of the cellar, and stored it in the shed in the hotel yard ; t had used aboat half a hogshead ; the beer was downright bad ; have good cellar accommodation ; •for beer; never had beer go bad before ; the p.n. had been paid on due date. v ' Cross-examined '; Could not give~ the date the beer arrived in Peildmcr; it was m November sometime ; XXX ale is thecommonest beer made by brewers, but there might be worse ; it is supposed to be a very decent beer; the beer arrived on 23rd JNovember at the Feildmg Bailway Station ; could not say it arrived; in good order, as he bad not sampled it; reckoned his loss of custom at LlO. Re-examined: At the time he found the beer bad, lie expected the commercial traveller from the firm shortly ; the, fol« lowing persons complained of the beer, viz : Mr Pope and several brewers.
