A case, which Mr Justice Chitty described as one? of great hardship, came before his lordship the other day. in the Jnntter <>f B»H, deceased, wherein a Lin« colnnhire farmer, ?5 )'eurs of age, claimed against the pstnte of the deceased, who lind been his solicitor, £13(10. the balance of £1500 entrusted to the solicitor for inYcxtiiifiit. When the solicitor died, the dent instructed a new solicitor to applj' fo- delivery of the security. The client receive-! the interest up to July. 18S4 since wliicli no interest ha<4 been paid, ami the client— to whom the money, which, in his old »«<>, w-is ail his property. wa* lost — now clnimed against the estate of the first solicitor. Mr Justice Chitty dismissed the claim, holding that as the security li.-id b'-ea three years in the client's hands, if the solicitor had exceeded his authority the client had ratified his act.
