Feilding Borough Council

The usual fortnightly meeting of the above was held at the Council Chambers on Thursday evening last. Present — Crs Goodbehere (in the chair), Nicholas, J. C. Thompson, Richardson, Worsfold, Eade, P. Thomson, and Fowles. The newly elected, Crs Goodbehere, Worsfold, and P. Thomson having made the usual declaration, took their seats. The minutes of the last^ordinary meeting were read and confirmed. | CORRESPONDENCE. „ ' J. L. Ress asking a bridge and crossing he put opposite his place on Kimbolton road; E. J. Cottrell applying for a refund of half of certain expenses he had been at in putting down footpath opposite his store in Manchester street; W. S. Staite, solicitor for Mr Blackmore and others, asking that a certain obstruction to Bowen street be removed. Cr Goodbehere reported that certain arrangements had been made to stop litigation where illegal charges had been made by the Poundkeeper for trespass fees. a <■<, Cr J. C. Thompson said that several other cases were imminent, but by prudence they could be averted. The report of the Curran accident committee was read as follows :p- . BEFORT BE CURBAN. . s As instructed, Cr Thompson and myself saw Mr Curran in respect to his letter, por Mr Staite, received last meeting. Mr Curran says there;; was no one nearer than ten chains at-the time of the accident. H. Curran was sitting on his load on the dray, when the horse shied, taking the dray into the gravel pit. Mr Curran would ask the Council to grant him, £50 as some slight compensation for his loss and his son's hurt. J. W\ Eamb September 17, 1885. v Cr J. C. Thompson spoke in regard to the above case. He had made careful enquiries. One informant said the boy was a careful driver. The only one who saw the accident , was young Gray, who- saw the ©art? go over. - : ■••■-'- Cr Goodbehere questioned whether a man should be allowed torideVon top of his load. '** Several Councillors gave their experiences on the proper modes of driving, both in London and in 'the wilds of Australia. Cr Worsfold said the Committee had not furnished any particulars of the accident. Cr P. Thomson gave particulars of the ground where the accident happened. He held that the Borough had taken the responsibility, when they took over the road., He advocated making a concession to prevent ► litigation. y, Cr Eade spoke on the report. -£ jf Cr Goodbehere said, in replytto Cr , Fowles, that the only thing to be done was to obtain legal advice on the subject. The Council could not vote away money unless they were convinced they were liable. -.4 Cr J. C. Thompson would snpport the Chairman in his view. Cr Nicholas said he would take the advice of local solicitors. He moved, seconded hy Cr P. Thomson, That the opinion of Prior and. Sandilands -he taken on the chum made by Curran. Cr J. C. Thompson spoke against the motion. Cr Richardson spoke in favor. Cr Goodbehere moved, an-amend-ment That the the point be r^orredto. Messrs Chapman and Fitzgerald, -of Wellington. Thomson here, asked if it was not the duty of Councillors to stand up when they addressed Hie chair. ... The Chairman said there, was a bylaw to compel Couneilloss to do so, but they had not been very strict in enforcing it. He would endeavour to do so in future, as business, would bo much facilitated thereby. Or Goodbehere here mentioned that certain refunds would be. made where overcharges had bran; made ih the poundage trespass fees. With reference to Mr Staite's letter, Cr J. C. Thompson thought tiie letter should simply be received. It was only a piece of meddlesomeness on the part of somebody. Cr P. Thomson thought it would be best to take down the obstruction to prevent litigation. ' Cr P. Thomson, and Fowles be appointed tiie Cemetery Committee. Carried. Proposed by Cr Worsfold, seconded by Cr Nicholas That Crs Eade, Fowles, and the mover be appointed the Library Committee. Carried. Mr Cottrell's application was then considered Cr P. Thomson said he did not consider Mr Gottrell had any claim as he had not made formal application to tho Council for permission to make the footpath or erect the verandah in front of his premises. Cr Worsfold proposed, and Cr Richardson seconded, That Mr Cottrell's application cannot be entertained. The following portion oi Mr Bray's tender, which had been held over from last meeting for consideration, was then read : — - FOOTNOTE TO ENGINEER'S TENDER. I further beg to offer to do the whole of the engineering required by your Council, viz., to lay out, prepare plans and specifications, and superintend the carrying out of all works executed by your Borough Council, including maintenance for the sum of four per cent, on the cost of all the works. Inspections on proposed works, or repairs, or other work being the duty of the Engineer, to he free, or included in the above price. C. BraY, Engineer. Cr Thompson proposed, and Cr Bichardson seconded, That the offer of Mr Bray to act as Engineer to the Council be accepted, and that Messrs Prior and Sandilands he instructed to prepare a draft for an agreement defining his duties. Carried. Cr Fowles proposed, and Cr Nicholas seconded That the Engineer be instructed to prepare plans and specifications for the formation of Hobson atreet. The same to he on the table at the next meeting of the CouncilCarried. Cr Nicholas moved, and Cr P. Thomson seconded, That a valuator be appointed. — Carried. Cr Nicholas proposed, and Gr P. Thomson seconded That tenders be for from persons competent to value the rateable property in the Borough, such tenders to be sent to the Borough office 14 days from this date. Carried. Mr C. F. Gray teudered for clearing a portion of the Cemetery grounds of loose manuka, &c, for the sum of £2. It was moved and carried that the tender bo accepted. Cr Richardson handed the clerk a notice of mo tion. Proposed by Cr Worsfold, seconded by Cr P. Thomson, That the PublicWorks Committee be requested to erect about three chains of fencing to protect roadway to the Kiwitea stream also the gravel pits in Kimbolton road. Cr J. C. Thompson opposed the motion on account of the expense. Cr P. Thomson said Cr Thompson's opposition was simply ridiculous. The place mentioned was very dangerous. It ought to have been fenced years ago. Cr Goodbehere agreed with the motion. Cr Eade said there were many other dangerous places in the Borough, and all the revenue could easily be spent in making them safe.
