This application was not favorably received by the Council, and was refused on the grounds that the Council was not in a position to undertake any new works at present. In our opinion the grounds of this refusal do not appear very just. The Council was not asked to do any irrtrlr or to be at any expense whatever beyond that of the Borough Engineer (we presume) making an estimate of the probable cost of the work and passing it after completion ; further, it is more than' probable that, underthe circumstances, Mr Lyote would have advanced this •amount also until the date when the Council was prepared to make a refund to him for the whole of the work. There are plenty of parallel cases to be quoted from the proceedings of the Manchester and Kiwitea Road Boards to support Mr Lyne in his application, and we do think that the Council has failed to give proper consideration to a very reasonable request The resolution arrived at was also somewhat illogical, inasmuch as it refused to do that which Mr Lykb did not ask them to do; that is, .to be at any present expenditure. We hope that Mr 6yke will not be deterred- from repeating his petition by this one failure, which, after all, may be more the result of inadvertence than any desire on the part of the Councillors to check enter*
