Malicious Injury to Property.
At the R.M. Court this morning before F. Y. Lethbridge and J. H. Fry, Esqs. J.P's., Robert Signal was charged, on the information of D. H. Macarthur, agent of the E. and C. A. Corporation, with doing certain damage to a cottage at Halcombe on the 16th of February last. Mr Goodbehere appeared for the Corporation, and Mr Hankins for the prisoner. Mr Goodbehere, in opening the case, said it came under the 51st section of the Malicious Injury to Property Act, and read certain documents to show that the accused was only a tenant at will of the property in question, which belonged to the Corporation, and that the accused had therefore committed an indictable offence. Mr H. L. Sherwill was then called. Mr Hankins, however, objected to any witnesses being examined until proof had. been famished of the Corporation's title to the property. This having to be obtained from Wellington, Mr Goodbehere, applied for a remand, which was granted. Accused was allowed bail, himself in £50, and two other sureties of £25 each. Accused was then liberated to appear again on Saturday, the 23rd instant.
