THIS DAY.
(Before R. Wabd, Esq., R.M.) Constable Price v G. Witchman.— TLis was a charge of entering a railway carriage while in motion, at Turakma. Fined 10s and costs, 9s; witness, oi. ASSAULT. Larsen v Seigel. Mr Goodbehere for plaintiff and Mr Prior for defendant. Plaintiff deposed: On 30th December ordered some meat from Seigel; had a dispute about it ; met defendant on dth Januaiy and had a conversation about the meat ; defendant shook his fist in his (Larson's) face and asked him to fight ar.d had previously insulted him ; oid not tell Seigel he was no butcher ; have refused to supply him with~bread. F. Fauthorpe, a boy, deposed: -Mr Seigel came into the shop and threatened ■•Mr'~Larsen, but he (Seigel), did not touch Mr Larsen. Cross-examined : Larsen was in tli'.' blacksmith's sho]), when Seigel came up ; Seigel was speaking high words; Seige 1 said he would go outside aud see who was the besi man. C. Seigel deposed : Was a butcher at Halcombe; went into the blacksmith's shop to see Larsen about a piece of meat sent back ; he refused to .pay for it; did not use bad language about his wife; couldn't swear how close he put his list to Larscn's face as he did not measure it. The charge was dismissed, each party to pay their own costs. Lewers v Looney. Claim for £.18 2s od. Judgment for plaintiff with costs. Lewers v Pickersgill.— Claim for tl Ss 3d. To be paid in Id days, or in default to be sent to Wanganui gaol. G. Pones v J. H. Lloyd.— Claim for £15 3s Ud. Judgment by consent. I THE ELOPKMKNT CASE. R. Robinson vW. Wakefield.-Chargtd with stealing certain wearing apparel, &C value £11 9s .(3d. Mv Prior for plaintiff, and Mr Hutchinson for defendant. R. Robinson deposed : Was a contractor, residing at Makino.; last saw Lis wife on Monday, December 11th ; Wake-fi.-ld was lodging with him since the month of May; there was a quantity of clothing and a sewing machine found in the trunks in prisoners' possession belonging to me, valued at about £11 ; went lo Nelson and saw prisoner in custody; was not aware his wife had left her home until informed on tho Monday by Mr Gauge; had two children. Tue information was withdrawn, and a fresh one laid, bringing it within the jurisdiction of the court (viz., £5 value) to be dealt with summarily. R. Robinson's examination continued: Pis-dier admitted co-habiting with his wife in Wanganui ; he asked witness to mike the charge light. Cross-cxi mined by Mr Hutchinson: Di I no' think st necessary to call witnesses to hear the conversation that took place between himself and the prisoner on the st. amer coining from .Nelson ; witness' .-tcufathcr was sitting iv the hatchway ; swear to the conversation having taken pace; witness used the pr soner's shirt ; witness never liked the shirt, as it did not suit ; swear there was no swap ; prisoner's clothes wero washed by witness' wife; Le only, came Lome once a fortnight frjm Ashurst ; did not know Le was in debt to Wakefield ; left the management of the place to his wife. Ro-examine I : Prisoner wanted to give a black hat for the coat, which witness would not part witii because it had been Lis father's. Trunk No 2 was now opened in Court, and a white sheet and sewing machine were identified by the plaintiff as Lis property. Andrew Diamond deposed : Knew Robinson and his wife and the prisoner; saw Wakefield lift the cases into the train, on the Idth December; was in Wanganui and saw Mrs Robinson in O'Hara's boarding bouse, sitting by prisoners-sides -side at the table having dinner. Fred Williams deposed : — He was a cabman in Wanganui, and took 2 boxes and 1 sewing machine to the steamer for Wakefield, from the railway station, who paid him for it. Mr Hutchinson made a most able speech for the defence, after which His Worship dismissed the charge. The rape case, Christopher Hall v Robert Nixon, was being heard as we went to press — d p.m.
