FEILDING R. M. COURT.
. — «, THIS DAY. (Before R. Ward, Esq., R.M., and H. L. Sherwill, Esq., J.P.) BBEACH BAILWAY BBGULATIONS. Arthur Adsett was fined 10s and costs, 7s, for getting into a railway carriage winle in motion. TWBEGISTEBED DOG. Fred. Ellern v W. Warne.— Having an unregistered dog in his possession. Fined 8s and costs, 345. LABOENY. William Spooner and Thomas Barker were charged with the larceny of a con« certma, the property of William Sheerin. Mr Ksam appeared for Barker, who pleaded not guilty. Spooner also pleaded not guilty. James Westwood and Mrs Keen were examined as witnesses. The prosecutor and Cons able Price also gaye evidence. The R.M. dismissed the case with a caution. CIVIL CASE. C. Seigill v J. Golds.— Claim for £4. 10s sd, meat supplied. Judgment for plaintiff with costs. DISPUTED OWNEBSHIP. F. Bryce v. W. Arnott — < 'laim for £30 ss. Mr Prior for plaintiff, Mr Esam for defendant. This was a horse case in which disputed ownership had arisen after the horse, in question had been sold at public auction by defendant and purchased by plaint ff, who, from the fact of the disputed ownership, was unable io obtain possesion. 'Iho claim was for loss of service of the mare and expenses of living. M r F. Bryce deposed that he was at Halcombe and Sherwill's sale, and remembered a mare being put up and described as a Day Dawn mare, at the time of sale. He purchased her for £7 ss, and rode the mare for two days. Ho received a telegram from Halcombe and Sherwill when he was in Wanganui, as follows :— " Are you willing to give up mare; she was sold in error; you will be recouped." The mare wjg in Feilding. Saw Mr Sherwill on Ks return to Fedding, who told him the circumstances of the mare, and in consequence declined to give up the mare to Arnott, aa he was not satisfied that he would be justified in doing so. Mr Sherwill told him Arnott had sold the mare in mistake. He left the mare at Morphy's stables until the question was settled. Arnott wanted him to take the money back and give up the mare. Ho refused until he knew the owner Arnott offered him £1 as compensation ; but he did not want compensation. He only wanted his money. He could have sold the mare at a profit of £5.
