THE SALE OF A PROPERTY.
GLASHI FOR COMMISSION FAILS. The hearing of a claim by Messrs McGough and Hawke, land agents, Pukekohe, for £B6. ss, commission on the sale of a certain property, from Mr M. Vadonovitch, of Buckland, occupied the attention of Mr E. W. Burton, S.M., for the greater portion of the last two Court days, eventually concluding on Thursday last.
Plaintiffs claimed that the sale of tne property to a Mr Fountain was effected through their introduction. The defence w*as that the plaintiffs endeavoured to sell to Fountain a property owned by a Mr Fallowes, but it did not come up to requirements. Mr Fountain knew Yadonovitch’s property was for sale, and after inspecting Fallowes’ farm went to defendants when Fountain’s adviser introduced the buyer to defendant. The plaintiff firm took no part in the transaction whatever. After hearing the evidence the Magistrate found that plaintiffs were not the real and efficient cause of the sale. He gave judgment for defendant With costs amounting to £8 4s. Mr P. H. Beasley appeared for plaintiffs, and Mr J. F. W. Dickson I- for defendant.
