MAGISTRATE’S COURT

THURSDAY, SEPTEMBER 26. (Before Mr J. R. Bartholomew, S.M.) Judgment by default, with costs, was granted in the following cases: —W. H. Huthnance and Co. v. E. Low (Outram) , £5 12s, for goods supplied; Donald Reid and Co. v. L. A. Wylie (Rotorua), £B. for goods supplied; A. Smith and Co. Ltd. v. J. Thompson (Kelso), £1 2s 2s, for goods supplied. CLAIM AND COUNTER-CLAIM. A claim for the return of a ledger, cash book, and a bank pass book, allegedly wrongfully detained was brought by Alfred Haynes, Alfred John Haynes, and William John Haynes, formerly in partnership as the Dominion Picture Moulding Company, against Austin K. Toomey, of Invercargill. The plaintiffs claimed £lO as damages arising out of the defendant’s action. The hatter conn.

After hearing lengthy evidence, judgment for the defendant was granted on tho counter-claim, with costs (£1 8s). On the claim the books were ordered to be returned to the plaintiffs, _ and £2 damages were granted for their detention, with costs (£3 18s).
