M‘ln tosh for damages amounting to £29 16s 6d, arising out of alleged assault at the South Otago Freezing works on Juno 16. Mr O. J. L. White appeared for plaintiff and Mr R. R. Grigor for the defendant. Mr White said that on the Friday before tho works closed down a meeting had been held and after a dispute defendant struck Georgo Rawson and the plaintiff got between them. It was a trivial matter, but the defendant boro malice evidently, and when tho men were knocking off at 5 p.m. defendant went to George Rawson and asked him what ho was going to do about it, and the latter said he was under the care of the doctor and was not going to fight. Defendant said he was “ yellow ” and then went to the plaintiff and asked him what he wanted to interfere for and without warning knocked him down twice and hammered him on the ground. Th: result was that the plaintiff was so knocked about that he could not work for a week. Evidence was given by the plaintiff, George Rawson, Roy Marshall, and John A. Weir, foreman slaughterman. Mr Grigor for the defence said the men were annoyed about the “ daggy ” lambs and the action of George Rawson, and if the plaintiff had not interfered there would have been nothing further. It was merely a freezing works squabble. Evidence was given by the defendant who said that the butchers objected to “ daggy ” sheep. There was a clause in the award against it. George Rawson had been killing these and said ho would continue to do so. Ho had always been antagonistic to witness over union matters. He gave George Rawson a crack in the face and the plaintiff had stepped in and said to “ leave it till 5 o’clock.” Later the plaintiff struck him behind the oar and jumped on his back. Someone pulled him up and the plaintiff and he then exchanged several blows, Rawson ending on the floor. Evidence in support was given by James M‘Laren, Clutha O’Hara, John "Weir, and John Telford, employees at the works. , , Dr Radcliffie said he attended! the plaintiff, who was suffering from two black eyes, bruises on tho face, and a sprained thumb. He was off work for a week as a result of the injuries. In giving judgment. His Worship said it was quite clear the defendant _ had been looking for trouble. He admitted regarding what had transpired' when he went to George Rawson _ and later sought the plaintiff. Ho did not think witnesses for the defence had seen the fight. He was satisfied the plaintiff had been assaulted, but after ho had rushed at the defendant and struck him, what

then happened) was his own fault. Damages would be allowed on the first, assault only for £1 8s 6d and £3 general damages, with £5 15s costs —a total of £lO 3s 6d. MINIATURE RIFLE SHOOTING.
