APPEAL COURT
ACTION BY ADMINISTRATORS [Per United Press Association.] WELLINGTON, September 17. The Appeal Court is hearing a Napier case in which J. R. Gower and R. L. Gower are appealing against the judgment of Mr Justice Smith, who in November last entered judgment against them as administrators in the estate of Benjamin Gower, deceased. The claim was for the sum of £4,400, principal and interest, the plaintiifs in that case being T. C. Cornford and W. D. Gillies. Defendants had argued that the effect of the extension of the mortgage previously granted was to bind them only in the personal capacity, but this was rejected by Mr Justice Smith, To-day the Appeal Court is hearing an application by appellants _ for leave to call fresh evidence, and this application is being opposed by the respondents.
