NONSUIT UPHELD
CDURT OF APPEAL'S DECISION [Per United Press Association.] WELLINGTON, September 16. The Court of Appeal unanimously refused leave to Ronald Parkes, of Palmerston North, a farm hand, to appeal as a pauper from a judgment of nonsuit against him given by Mr Justice Blair in’July. Parkes,' who was injured' in a motor cycle collision, unsuccessfully sued Harold Arthur Beagley, of Palmerston North, a paper runner, in the Supreme Court for damages, the case being withdrawn from the jury after evidence in support of his claim had been given. The Court of Appeal was satisfied that Parkes could not possibly succeed, that the judge in the court below was right, and that the leave sought should be refused. ' .
