MAGISTRATE’S COURT

MONDAY, JUNE 11. (Before Mr J. R. Bartholomew, S.M.)

Judgment, with costs, was given for the plaintiff in the following cases:—■ Dunedin City Corporation v. Hugh M. Miller, £53 Is Id, rates due; same v. May A. Foord, £l7 5s sd, rates due; same v. John N. Brown, £l2 15s Bd, rates due. MOTOR COLLISION CIAIM. Henry Owens, on behalf of William Roger Owens, infant, of Kaitangata, proceeded against Andrew Nelson, of Brighton, on a claim to recover £6O, general damages, and £2O 4s, expenses incurred as the result of' a motor collision. Mr C. J. L. White appeared for the plaintiff, and Mr B. Wilson represented the defendant. The statement of claim set out that on March 6, 1933, the plaintiff was proceeding in a motor car driven by one George William Thomas in a southerly direction along Main South road. When in the vicinity of Titri railway station, a collision occurred between the said car and a car driven by the defendant, who was proceeding north. It was claimed that the collision occurred through the' negligence of the defendant; that he failed to keep a proper look-out for traffic approaching from the north; that he failed to keep to the left side of the road; that he drove his ear recklessly and generally in a manner dangerous to the public. After lengthy evidence for the plaintiff had been heard, the court adjourned until the afternoon.
