(Received February 29, at 11.30 a.m.) At the resumption of the KennedyBrowne case, Mr O’Connor, counsel lor Browne, drew attention t,o the widespread publicity given Kennedy’s alleged statement implicating Browne. The magistrate replied; “11 *ae statement is the only evidence against Browne I will not commit him lor trial. The statement is not evidence against Browne.” The evidence was largely confined to witnesses detailing the movements of the car in the neighborhood of the murder. Browne read a motor journal, and appeared disinterested. Kennedy’s eyes were fixed on the ceiling. Inspector Barker described the discovery of a dirty grey mask and a fancy dress in Browne’s house, also a car license, of which Browne said: “That is a dud license in case 1 was stopped.” Cross-examined, inspector Barker said that a few hours alter his arrest Browne denied any connection with the murder. h
Giving evidence regarding Kennedy’s arrest at Liverpool, Detective Matliieson said that he recognised Kennedy when leaving a house which was under observation. Detective Mathieson called out “Halloa, Bill, come on.” Kennedy wheeled round and said: “Stand back or .1 will shoot. Detective Mathieson closed with Kennedy, who whipped out an automatic and thrust it into his ribs. He heard a metallic click, and gripped Kennedy’s arm and gave it a twist, simultaneously striking him a blow on the lace, partly upsetting Kennedy’s balance. Ho seized the revolver and thrust it into Kennedy’s back and marched him down Hie street, where other detectives were concealed. At the police station Kennedy said that he had no grouch against the police, but that Detective Mathieson should be in heaven. The case was adjourned.
