Inspector Mallard said that the practice of the Court hitherto had been to sentence persons convicted of this offence tp three-months' imprisonment, a_nd then, allow them to "commence de novo with their past delinquencies 1 wiped out; but he thought that was not the intention of the Act, whicli empowered Justifies to , convict on each case independently of any previous sentence! This prisoner had previously served a term in gaol for the same offence with which she was now charged, and his opinion was that the law should be held in (errorem oversuch characters.—Miss O'Leary pleaded veher mently for mercy, and said she, was unable to-bear,-more punishment; but the Bench thought'differently, and sent her to h* old thr(§e"mdnthsr ' ~AT third charge against her, .of damaging, .property in the prison cell of the value of 3s was dismissed; Insulting Language. —,James Smith pleaded not guilty" to a Cb'arge of using tbusive language to a railway officer on the sth'November last. Mr StoutrftppeareS for the railway authorities, and stated that if the Bench thought ib would "be better he would-amend the information, and: make it under the YagrairiV Act instead of the railway bye-laws..—The .Bench agreed with Mj* Stout, and the information was amended.— Thomas Mitchell, station-master at Dunedin, testified to the foul language used by accused, and he was Sued 20j ; in default three days'imprißonmeat.
