■■"■ iJ. Bathgate; Esq.rßM.) ~ ■* M'Cliskey v. Watt.—Mr Hay, for defendant, asked for an adjournment, which was granted until December,2o. Robert Daniels;— " Claim, L 5 10s, tor rent. His Worship, in giving judgment in this case, said that he had given careful consideration to the* evidence given, and had come to the conclusion, that it was evidently intended by defendant to obtain a lease of the ground; but the month's notice to quit was accepted by him—in fact, "was his own' proposition. Under the Statute of Frauds a tenant for three years became a.tenant at wUI; but in this case the only proof of tenancy was the payment ot rent, which, even putting the matter in the most favorite light for defendant, only made him a monthly tenant. If defendant had not intended to vacate he should have said so when he got the month'B notice. Judgment would, be for plaintiff with costs.—Mr Bathgate: With immediate possession?—Mr Hay: That- is the point at issue. I ask his Worship to give my client time to clear out.— -id Worship : I will not carry the matter to esttremities, and will allow defendant a week to give up possession. Inglis v. Margaret M'Dougall. Claim, L 6 19s 4d, on a judgment summons. Mr Lewis for plaintiff,—His worship remarked that he could not make an order against a single woman for that amount; and ordered her to pay LI per month, or forty-eight hours'imprisonment. John Skene v. Thomas Richmond.— Claim, L 5 12s 9d, commission for supplying servants. Mr Hay for plaintiff.—Judgment by default with costs for amount claimed. Same v. Frederick White. - Claim, L2 6s 9d, commission. Mr Hay for plaintiff.—Judgment by default with costs for amount claimed.
In the cases of O'Connell v. Wain, and Couston v. Kerr, his Worship intimated that judgment would be given next Wednesday, as Ml* Mansford was unable to attend to-day owing to an attack of influenza.
