RESIDENT MAGISTRATE'S COURT, PORT CHALMERS.

Friday, October 13. (Before T.. A. Mansford, Esq., R.M.)

Drunkenness. —■ Edward Law pleaded guilty to this offence and was fined ss, with the usual alternative.

Assaulting a Captain.—Henry Ford, on remand, was charged with assaulting James Hill, master of the barque Anazi. Air Joyce appeared for the prisoner, who was again remanded till 2 p.m., in order that Mr Stewar., the counsel fur Captain Hill, might be present.

Throwing a Waterman overboard.— William Donald, John Kennie,} John Innes, and Christian Hanson, charged with unlawfully assaulting William Jewiss on the 6th inst., came up for judgment. His Worship in reviewing the evidence stated that it was very clear Jewiss had given a distorted statement of the case, while Donald, the second mate, who was in charge of the men at the time of the disturbance, seemed to have been desirous of preventing loss of lite, and thereupon determined to land the men at the point. To this Jewiss made no opposition, and it was not till he found the prisoner Kennie with the boat's painter drawing her towards the beach that he interfered and struck him. On this a free fight took place, and according to the evidence of one of the witnesses they were all thrown oat of the boat and floundering about like a lot of porpoises. He did not consider the charge of unlawful assault proved, and dismissed the case without costs.
