Tuesday, September 26. (Before J. Bathgate, Esq., R.M.)

Reany v. Roberts. - Claim Ll7 13s 4d, balance of account due on a judgment summons. Mr M'Keay appeared for plaintiff, for whom judgment was given, with costs. Defendant to pay the amount at the rate of 10s per week, or seven days' imprisonment.

Calcott v. F. W. Wilkens.—This was a case submitted to the Court of Assessors to fix the increase of value of certain land belonging to one Wilkens, an absentee owner, the frontage of whl-h was taken for railway purposes. Mr Haggitt conducted the case. —S. H. Mitams, civil engineer and surveyor, said he had examined defendant's land now in question, which was situated three quarters of a mile below Ravensbourne. Tht-re were two small pieces, of 23 poles and 11 poles each. Before the construction of the railway witness valued this land at the iate of LSO -per acre, or, for the 34 poles, LlO 12s 6d. Although the land had increased considerably in value since the construction of the railway, it had depreciated again through access to the river frontage being cut off by the railway. LIOO per acre would be a fair valuation now.—J. A. Connell, surveyor, valued the land at the present time atL3l 17s 6d.—The Court considered that the land had benefited to the extent of LIOO.
