Monday, August 14. (Before His Honor Mr Justice Williams.)

Re Riceabd Stbatford. —Adjourned final examination of d scharge. Mr Edward Cook appeared for the bankrupt, and explained that the trustee was absent from the Colony through il -health, and that there was no trustee’s report consequence. Mr Leary, the trustee, was not expected back for a month, hut before he went away he left a series of questions to ho answered by the bankrupt. Thus there was a report in substance though not in form.—-Ilig potior read the 150 th section of the Act, and said he did noi think he could grant a discharge without the trustees’ report. If Mr Leary was not in a position to report he suggested that another trustee should be ap-pointed.-—Mr Cook then asked for an adjournment for six weeks, which was granted. Be Geo. Htde Campbell.— Mr Cook, instructed by Sievwright and Stout, appeared for the bankrupt, who, he stated, was in Melbourne.— His Honor said that if bankrupt attached any importance to getting his discharge he ought to have been present to undergo examination if necessary. He would adjourn the case for a fortnight to give any of the creditors who wished to oppose an opportunity of doing ao. If at the expiration of that'time there was no opposition the discharge would be granted aajthe trustee's report wss favorable.
