Tuesday, May 30. (Before His Honor Judge Bathgate.)
Henry Clark v. Alexander Jerusalem Smyth.—Claim, L2OO, for breaking info plaintiff’s land, cutting down trees thereon, and throwing on to it a quantity of soil and stone. Mr E. C. Strode appeared for plaintiff ;Mr Haggitt for defendant.—The plaintiff .is a dairy-keeper at Purakanui, and the alleged damage was done by defendant while constructing the local railway line. Plaintiff said he had purchased the land from the Government about three years ago, at 20s per acre, and he would not have taken L6O for the tihaber removed.—The following: witnesses also were examined :—Alexander M'Goun, owner of land adjoining plaintiff’s ; John. Williams, employed by’defendant in haufinj timber off plaintiff’s land i ; J. M'Leod ;i A. J. Smyth, who stated that he was not aware that he had been cutting over the proper line; and had never admitted having done so;
Job Wain, contractor under Government, and others.
