RESIDENT MAGISTRATE’S COURT, PORT CHALMERS.
Tuesday, May 16. (Before T. A. Mansford, Esq., R.M., and Dr Drysdale, J.P.) Drunkenness. Edward Marshall and Thomas Jones, after receiving a severe re* primand from their Worships, were dis* charged with a caution. Largest —George Kendall was charged with stealing, at Mosgiel, one coat and two shirts, of the value ot L2, the- property of George Campbell. Accused pleaded not guilty.—George Campbell deposed that the accused had been stopping at his tent for about a fortnight. On Friday morning accused asked witness if he could lend himhis coat, as he wanted to go back to where he hn-d been at work. Witness lent him the coat, but shortly after accused left found the whole of his clothes out of his bag and missed a flannel shirt. The other shirt he had previously lent to accused, the coat procuced was his property, and he had not authorised anyone to sen the same. Ho valued the coat at Ll and the shirts at 6s each.—William Solomons deposed that he met the accused in Dench’s Hotel on Saturday afternoon, and at the earnest solicitation of accused purchased the coat produced for 7s. Constable Nicol deposed to arresting the prisoner, who he knew was a deserter from the ship Rakaia. Upon questioning him, accused denied till knowledge of the robbery, but shortly after stated that he was the man.—Accused, in defence, stated that it was through drink he sold the j tended have got Work and refunded the value of the articles to prosecutor. The Bench said there was no doubt of the prisoner's guilt, and sentenced him to be imprisoned ana kept to hard labor for two months.
