M'Grcgor.—Mr Harris applied for a rehearing of this case, heal'd iu January last,, when his Worship gave judgment, in plaintiff’s favor for LSO. tor the value of a horse which it was proved in evidence was irretrievably injured by the negligence of defendant’s servant. Bince then it transpired that the horse had been carefully tended, and was iu good and usable condition, but the defendant refused to deliver it up. As. proof of service of notice of this application was net forthcoming, his Worship said it would have to be made afresh. Oliver v.
