Thursday, March 80. (Before Judge Bathgate and J. T. Thomson, Esq., and A, W. Morris, Esq., J.F.'s.) RAILWAY COHPBNBATIOH CASE. Thos. Calcutt, Government Assessor, v. William Hepbnrn, auctioneer.—An action brought by Thofe. Calcutt, of Goodwood, Otago, assessor appointed by the Minister of Public Works under the Immigration and Public Works Act Amendment Act 1871, to recover possession of certain lands, hereditaments, and premises required for the purposes of the line of railway from Dunedin to Moeraki under the provisions of ti'e Immigration and Public Works Act, 1870, and the Acts amending the same and the Bailway Acts, 1870 and 1873. The pleadings set forth that plaintiff had expressed his willingness to purchase from the defendant the said land, and to allow compensation for any damage that might be sustained by the execution of the work for which the laud was required, and that plaintiff had offered LSOO compensation, but that defendant required L 1,900. The land comprises 3 acres 1 rood, and 34- poles, being part of section 38, block 1; 'S acres 2 roods 20 polos, being part of section 39, block 1; and also 1 acre 3 roods 4 poles, being part of said section 39, Hawksbury district. Mr Haggitt appeared for Mr Calcutt. representing the Crown; and Mr Stout, for Mr William Hepburn.—A vast quantity of evidence was token. Mr Hepburn stated that the principal item of depreciation was L2 per acre all over the property, owing to the railway cutting up the land. [tyjft sitting.]
