Peotovoot akd btmmw. t special case submitted for the decision of the Court Originally ifc was an action brought by plalntifl to recover compensation for certainland taken by d*. fendants for the purposes of the Port Chahners Boil* way. The following points were agreed open •—fli If the Court shall be of opinion that there is a stotntory contract by which the defendants have become liable to pay the plaintiff the snm ef LSOO, then jadgmentshall be entered up for that situ with costs of suit; (2) if of opinion that there is no such statutory contract, but that the defendants are liable in trespass, the damages shall be assessed by a jury, and Judgment shall be entered up for plaintiff and damages awarded with costs of Bait, fa accordance with the general rales ; (3) ifofopinien that the plaintiff ought not tosnoceed in'any aspect of the case, then judgment to be entered up for the defendants, with costs. Mr G. E.- Barton, with him Mr H. Howorth, appeared for the plaintiff. Mr Macassey, with him Mr Hagaitt. for defendants. Counsel for plaintiff were heard yesterday, and this morning Mr macassey was heard for the defendant. Mr Barton then replied, and His Honor reserved his decision.
