Friday, Decembers, (Before T. A. Hansford, Esq., R.M.) Absa t LT.— Gordon v. Fail was a charge of assault preferred by one little boy against another. It appears that on the 25th ult., and whi e the children were returning from school, Albert Fail, the defendant, struck James Gordon, the corhplainant, with a piece of stick, hence these proceedings. Gordon, when crossexamined ar, to whether he had not provoked his assailant by throwing mud at one of his younger brothers, denied havingdone so. On the other hand, Fail as earnestly declared that Gordon not only threw mud at his (Fail’s) younger brother, bet th-.ew a stone at him. Dr Diysd -les'ii'cd that the cider Gordon brought the boy f- r examination on the evening of the 27th two days after the alleged assault—and stated that bruises were apparent on his legs - bruises such as, in the doctor’s opinion, could nob have been caused by the piece of word produced, unless laid on with great force. —Mis Worship said it was apparent it was a neighbor's quarrel, and he strongly advisid the parties to he more neighborly. He fined the defendant 2s 6d and costs, which amounted in the whole to 11s 61. Dr Drysdale refused to accept fees.
