John Collie v, John Sanders.—Claim for the non-completion of a baker’s furnace. The defendant failed to appear. John Mulrooney, slaughterman v. James Forsyth, butcher, Port Chalmers.—Claim, L 7 15s, balance of wages for work and labor as slaughterman.—Mr Joyce appeared for plaintiff ; Mr A. Bathgate for defendant. The defendant put in a set-off, which, it was contended, made plaintiff the debtor of defendant. After hearing evidence, his Worship said that the case was still in such a case of fog and confusion that he could not give a judgment for either plaintiff or defendant. Both paities were nonsuited.
