Monday, August 30. (Before His Honor Judge Bathgate.) M'Landrwjs, Hepburn, and • o. v. Driver bTIWART, an • Co.—This case was concluded after we went to press last evening, and his Honor reserved judgment.

Tuesdat, August 31. (Before His Honor Judge Bathgate, and a Jury of Four.) Wm. Chbistie v. the National Bank of New Zealand.-Plaintiff, formerly manager of the National Hank at Oaraaru, and now of the Colonial Bank, sought to recover from aefeudanta the sum of L2OO for wrongful dismissal. iWr Maeas-'ey appeared for plaintiff and Mr Smith for defendants, who pleaded justilisation.—The circumstances briefly stated a:e these :—Plaintiff was engaged as manager of tie Oamaru branch of the National Bank at a salary of LBOO per year, by an agrsenient dated in June la-t, the conditions being that the engagement on either side should be tei minab>e by a thiee months' notice. Absence without leave from tho bank premises warranted dismissal without notice. Piaintiff bavin- got an offer from the Colonial i Sauk, which he resolved to accept, wrote out his resignation at Oamaru on July 20. He then came to Dunedin aud ealled ;<t the National Bank to see Mr Bridges, the Inspector, but that gentleman not being in town he left his resignation and returned to Oamai u next day. On the following day Mr Bridges (who had heard of plaintiff's transference) wrote to him declining to aceept the resigna ti >n and dismissing him on account of absenting himself from Oamaru, and next dav sent up a man to take over the cash, \c. Throe days afterwards plaintiff went into the employ of the Colonial Bank. Tho question at issue was whether plaintiff's coming into town with his resignation constituted absent without leave. Plaintiff having been dismissed without notice sought to recover three months' salary.— Judgment waß given for LIOO.
