Southland Waste Lands Board. —Re Fatnck Kenny M'Lausrhlin wire the Southland \\ ast« Lands Board, appeal.-Mr Kettle applied for a rule nisi calling on the Chief Commissioner and members of the Waste Land rfoard to show cause why an appeal should not be heard on affidavit under section 6 of the Waste Land Board Appeal Act, 1867. There being no opposition the rule was granted. Otago Wa&te Land Board.—/)? re Waste liand Board Appeal Act, 1567. m re. section 6. Case for the opinion of the Judge. The Waste Land Board having met with some difficulty in constructing the provisions of clause 3 of the Otago Waste Lund Administration Act, 1&74, in conjunction with the powers given to the Board to sell or loaee land of special value under seotion 85 of the Otago Waste Land Act, 1872, the Board had, with the consent of the Superintendent, withdrawn certain land from sale under section 3 of the OtJfco Waste Und Administration Act, 1874. It was also decided with the consent of the Superintendent to offer the »aid land so withdrawn for sale by auction as being in the opinion of the Board and Superintendent lands possessing special value, and the Boird hud complied in every respect with section 85. In order to enable the Board to deal with confidence in their duties it asked the opinion of the Court whether the fact of land having been withdrawn from sale under seotion 3 of the OtaßO Waste Land Administration Act, 1874, precluded the Beard, with the consent of the Sufrom delaring the land of special va "i°-— iVir Barton having been heard on behalf of the Boai d, his Honor stated that the Board was not precluded from declaring the land of special value.
