RESIDENT MAGISTRATE’S COURT.
Wednesday, March 17. (Before J. Bathgate, Esq., R.M.)
Cole v, Goodison. —Claim L4O, damage sustained by defendant selling plaintiff an unsound horse. This adjourned case was continued.—Dr Farquharson, Y.S., said he knew the pony in question before plaintiff bought it. At the time he saw it first it was lame and showed symptoms of paralysis; but when he last saw_ it, it was lying in a yard and suffering from diseased fore feet. This second dim ease appeared to be an acute attack of ‘ founder,” as it could rise from the ground but not stand up. If suffering from spinal complaint it could not have risen from the ground by its hind-quarters as it did. The first disease appeared to be the commencement of paralysis. Cross-examined : Witness treated the pony for a different disease the second time, namely, disease of the feet. This might set in at a day’s notice, and was quite distinct from the former complaint—spinal disease. The two diseases were not linked together at all. Overheating and a sudden chill might cause the foundering.—Judgment was reserved. Gregory v. Henderson.—Claim LlO 12s lid, balance of account for work done and goods supplied. This case had been adjourned to allow of full particulars of claim being putjin. Mr Harris appeared for plaintiff; Mr Lewis for defendant, who put in a set off amounting to L 9 ss, and paid into Court the balance between the two amounts. Plaintiff, in turn, admitted L 6 15s of this set off, so that the amount in dispute was really only L 3 17s lid.—Judgment for plaintiff for L2 15s lid, and costs. Judgment was given in the following cases for plaintiffs, by default:—Shotover Goldmining Company (Limited) v. F. A. Little : claim LlO, unpaid calls on 200 shares; same v. David Proudfoot, claim L 27 6s 6d, for calls on 120 shares; same v. T. L. Stanley, claim LlO, calls on 100 shares; same v. H. Thomson, claim L2 ss, calls on ten shares; G. M. Aldrich v. Malcolm M‘Gregor, claim L4l6s, balance of amount due for a sewing machine supplied; Weir and Samson v. R. D. Thomson, claim L6O 16s lOd, for dishonest acceptance and goods supplied, [Left sitting.]
