RESIDENT MAGISTRATE’S COURT.
Wedenerday, January 27. (Before T. A. Manaford, Esq., R.M.) Drunkenness. Thomas Fogarty, for being drunk and disorderly, pleaded guilty, and was fined 40s, or seven days’ hard labor. Assault. Thomas Fogarty was also charged with assaulting Constable Hartnett while in the execution of his duty.— Inspector Mallard asked that the case be remanded, as the constable was not yet able to appear. * fill tbia day week was granted, A further charge of habitual drunkenness was remanded till the same day. Robbery. —Sydney Hodge was charged with having, on the 25th inst., entered the wool store of the New Zealand Loan and Mercantile Company, and taken therefrom lewt 3qrs of wool. Mr M‘Keay appeared tor the accused.—Herbert Crossley, woolvaluer said that he was in the employ of the New (Zealand Loan and Mercantile Company, of which Mr Driver was manager. His attention was called yesterday morning to the five bags of wool, which had been tampered with. He had the wool weighed, and, after doing so, found a deficiency of four bales.—George C. Tait gave similar evidence.—-Andrew Tunu, groom, in (the employ of Mr Driver, said he was returning to the store -at the rear of which he slept between ten and geven o clock on the night in question, He met Alexander M'Millau, watchman of the wharf, and walked, on in the direction of the store. When he approached the at'>re he saw accused sitting on the fence. He asked him what he was doing there, to which he replied that he was fishing. Witness iemarked that his being there at that time of night was very suspicious, accused replying that it was. Witness had observed the accused about the premises earlier in the evening. He then ordered him away.— Alexander M‘Millan and Detective Shury gave corroborative evidence. —Accused was sentenced to take his trial at the next session of the Supreme Court, and reserved his defence. Bail was allowed—himself in L6O ! and two sureties in L 25 each. *
