RESIDENT MAGISTRATE’S COURT.
Thursday, November 2G. (Before J. Bathgate, ,Esq., R.M.) Drunkenness. Two persons charged with this offence, were let off with a caution, CIVIL CASE. William Anniug, goldminer, v. R. B. Martin, merchant.—i his identical case was before the Court some weeks ago, and now, as then, plaintiff sued to recover from defendant the sum of L9O, for alleged breach of contract on defendant’s part in failing to send the Comet from Port Chalmers to the Calmer diggings Queensland, and LlO for passage money. Mr Barton, with him Mr flams, appeared for plainfff; Mr Bathgate watched the proceedings for M‘llroy; and vlr Haggit appeared for defendant, whose plea war that contracted as alleged, a»d that life was #ot te&hfcd.'-p-Thfe efcawj*,
nation of the plaint.ff, and of W. J. MTlroy occupied nearly the whole day. The former stated that he was from L6O to L7O out of
pocket, besides breaking Up his home, and the latte- was being examined when our reporter left.
