Friday, September 4. (Before His Honor Mr Judge Bathgate.) H. 8. Fish, junr , v. Gray and Drummond.—His Honor gave judgment in this case a claim for L 156 17s 9d, heard on Tuesday la it-for the plaintiff, for the sum of L 55 4s, without prejudice to plaintiff’s bringing a claim for the remainder against Messrs Wood and Stein an. Franz Ze deberg (builder) v. N. Wood (builder).—This was a claim for L17512i Bd, for material supplied, and balance of moneys due on Messrs Field and Jollie’s contracts The original claim was for L 641 10s 6d, and plaintiff gave defendant credit for moneys paid up to L 465 17s lOd. Mr Stout for plaintift ; Mr M Keay for defendant.— Mr Stout mentioned that their claim would be reduced by L6O or L7O. The reason that this had not previously been done was that defendant had refused to present bis set off, which would enable a satisfactory arrangement to be come to. [Left sitting.]
