CIVIL CASES.
Leary v. M'lntosh.—Mr Bathgate, who appeared for plaintiff in this case, which was an adjourned one, said that his client had agreed to accept a nonsuit, and judgment was entered accordingly. Margaret Patterson v. J. B. Robertson.— Olaim L2O, for damages sustained through breach of contract. From the evidence adduced, it appeared that plaintiff rented a house at Port Chalmers, with furniture, at a rental of Ll3O per annum, lor one year. The first month’s rent was paid on May 6, but before the next month’s rent became due, defendant got iuto difficuties, and the house was sold by the mortgagees. Plaintiff, who bad effected some alterations, thus lost possession of the house, and the furniture was removed.—His Worship thought the case premature, and nonsuited plaintiff.
