On the recent trial of Tweed, at New York his counsel, when the jury was about to be called, presented in court a protest against the being tried by Judge Davis, on the ground that he had formed, and upon a previous trial expressed, a most unqualified and decided opinion unfavorable to the defendant upon the facts of the case, and that he declined to charge the jury that they were not to be influenced by such expressions of his opinion.
