On the recent trial of Tweed, at New York his counsel, when the jury was about to be called, presented in court a protest against the being tried by Judge Davis, on the ground that he had formed, and upon a previous trial expressed, a most unqualified and decided opinion unfavorable to the defendant upon the facts of the case, and that he declined to charge the jury that they were not to be influenced by such expressions of his opinion. After fined three of those counsel “Mr W. F ullarton, Mr J. Graham, and Mr W. 0. Bartlett—2so dollars each. The junior counsel was only admonished. Judge Davis said:— Counsel have sought in vain to find an instance in the whole history of the jurisprudence in this country, as I think they would search m vain in the history of that country whence we haye dpriyed quf laws, for an occasion wnere the court hfts been approached in a manner like this with a paper of that character at the moment of trial, and counsel will fail, I think, ever hereafter to find a case where a judge, endowed with decent self-respect, will fail to take notice of such a paper. I have no hesitation m saying-that it is my firm conviction that if such a paper as that had been presented to one of the tribunals in England at this hour, clothed os these tribunals are with a power which the law of this country withholds from its judges, no one of the oouns** 1 vho Kll h tJ?
