WASTE LAND BOARD.
The weekly meeting of the Board was held to-day. There were present—The Chief Comraissionor, Messrs Bastings, Butterworth, Reid, and Clark. The following business was transacted : Messrs Gillies and Street, for Mr C. T. Marie, asked that the sale of the lease of section 117, block 2, Leaning Rock, should be burdened with conditions for payment to him of half cost of constructing road race and tunnel. The Board decided that the new lease be withdrawn from sale. Messrs Gillies and Street, for Messrs Guthrie and Asher, applied for a timber saw mill license, over an area of 600 acres, in blocks 6 and 7, Glenomaru district. It was agreed to grant the license onr the usual terms, beyond the purchased land, to the extent of 600 acres. Mr J, B. Von Tanzleman applied to purchase a section in the township reserve at Beach Bay. Applicant to survey for himself, and then the section to be put up with improvements added. Mr R. W. Capstick wrote relative to the superseding of his appointment as auctioneer for the Mataura district. The Board decided that the Mataura district being in the Invercargill Land Administration, it became more equitable to have the business done in that town, and thi step was taken without any disparagement to the confidence of tlm Board in Mr Capstick’s competence and probity. On the application of David Doull, for refund of deposit made on application to purchase section 30, block 4, Wyndham, the Government recommended to refund the amount. , m , Messrs Gillies and Street, for the lokomairiro Coal Company, applied for lease of the Coal Reserves in block 1 and 2, Akatore The company to have the option of taking up 150 acres at 10s per acre ; lease to commence on November 1 next. Messrs Connell and Moodie, for Messrs George and Ulaine, applied for lease of about half an acre of the Quarry Reserve, block 3, Oamaru, for business purposes. The application was declined. Plans of blocks 2, 6, and 7, Glenkcneich, wore submitted for approval and decision as to the boundary between Runs 168 and 167b The plans were approved, but the part in dispute between Captain Mackenzie and Mr M'lntyre was postponed. The opinion of the Provincial Solicitor, re the propos.d transfer of the lease of the bush reserve Glenoamaru to Thomas Pollock, was read as follows: —“There has been no breach on the lessee’s part. Then have ten years to erect the fence in ; they are not bound to clear any specified number of acres unless they do so of their own will; they appear to have cleared two acres, which should be planted at once. When there is a breach of covenant, the Government can take proceedings in ejectment, or determine the lease by taking possession, if quiet possession can be obtained, and also by taking proceedings on the bond to recover the amount of the bond.” The lease stipulated that every acre of land cleared by the lessees should be immediately planted with blue gums. The lessees admitted having cleared two acres, which were laid down in grass ; but they contended that no breach had been committed, as that ground, which was the only available place, was cleared solely to erect a mill and houses on. Mr Clark and the Chief Commissioner were strongly of opinion that the terms of the lease had not been complied with, and a majority of the Board declined on that ground to agree to the transfer.
