SUPREME COURT.- IN BANCO,

{Before his Honor Mr Justice Chapman.) Wednesday, August 20.

Jti’f/ina, ex relatione Hutcheson v. C. De V. Teschkmaker. —Rule nisi calling on the defendant to show cause why an information in the nature of a writ of quo warranto should not be exhibited against him. —Mr Stout appeared to move the rule absolute ; Mr James Smith (with him Mr Turton) for the defendant. By consent, the argument was adjourned till Wednesday, 3rd September.

In re The Dunedin Gaslight and Coke Co. (Limited). —Motion for dissolution. This was a mere formal motion for a dissolution of the Company, everything necessary to entitle the Company to a declaration of dissolution having been accomplished. -Chapman J. : Declare accordingly and take the order.

In re The Trusts op the Will op John Jones. —Motion for appointment of new trustees. On the motion of Mr James Smith, the prayer of the petition was granted. The Masonic Hall Company v. Hardwick and Others. —Motion for an injunction restraining the defendants from further proceeding in the sale of the mortgaged premises in the declaration mentioned, nnd from, taking poanea* sion thereof, and from in any manner using or occupying the same, or interfering with the plaintiffs’ possession or enjoyment thereof, and to restrain the defendant, Richard Hudson, in like manner from dealing with the said mortgaged premises until the further order of the Court. —Mr George Cook appeared for the plaintiffs; Mr Barton, with Mr Turton and Mr K. Cook for the defendants. By consent the motion was adjourned till 3rd September, on the condition, which was agreed to, that the eiffs should not in the meantime be moin their occupation of the Hall by any of the defendants. The time for pleading, also, was extended by consent until the hearing of the motion.

The Court then adjourned, his Honor having previously notified that he would deliver, on some day in the meantime, certain judgments which had been reserved.
