Monday, July 28. (Before I. N, Watt, Esq,, R.M.) Hocfcen v. Jones. —This case had been adjourned from Thursday last, in order that defendant might produce a witness on his behalf. Defendant appeared, but was unable to produce any witness, and had no defence to offer. Judgment was given for L2 4s, in payment of the windows broken by defend a t, and he was also sentenced to a penally of LIO for the offence, under the “down and Country Police Ordinance,” Bennett v. Court on Friday last. Mr Stout appeared for plaintiff, aiid in examining defendant elicited that he had been earning L 3 per week until lately, but that he has no money at present; that his furniture had been sold a few days ago under an execution, but that he expected sufficient money from the North Island to pay all claims upon him. He denied having told Mr Baxter that his wife had 1.5 ' or LGO in the house.—James Baxter, who also obtained judgment against defendant on Fridav, swore that defendant distinctly told him that his wife had that amount in the house, and that his debts would bo paid with it. —His Worship considered that defendant had not brought himself under the statute, and dismissed the case.
