Lung Chung v. Lung Cbing Sing,—A claim lor LC3 135,, amount due on an 1 0 U. Mr Stout appeared for the plaintiff, and Mr M'Keay for the defendant. Chung, who was sworn by blowing out a match, said the amount now sued for was the balance of aa account. The money had been owing since 1566, and the debt had been contracted in Victoria. Defendant was not plaintiff’s servant, getting LI per week and a percentage on gambling transactions. Plaintiff kept a store, which was not used as a gambling house.—Wong Hey proved that he made out a statement which showed that the number of days that had elapsed between the giving of the lOC and the t iking out of the summons was 2,183. The date in the account was 1866, not 1865. —Wong Tape and Lee Tcu gave evidence to the effect that the date mentioned in the account was 1806, and not 1860. —Lung Ching Sing, the defendant, said he was a miner, and knew Lung Chung, who had a gambling shop in Litt e Bourke street. Defendant was a storekeeper. In 1865, defendant took a house for Lung Chung aud party, as he (defendant) was able to speak Fn;lish. Defendant acted as clerk to plaintiff for three months, at L2 per week. lie did not owe plaintiff any money when he left. Defendant left plaintiff's employment on March 6, 18GG. Defendant did not write the paper produced. The plaintiff never asked for payment before he took out the summons. Defendant never got goods from plaintiff, Plaintiff gave defendant a sleeping share in the gamb ing business, a thirteenth part. Defendant never sent'the doctor to try and settle the ease.' Ah Tong gave evidence to the effect that the document was dated eight years back. The case was adjourned for a fortnight, the document to be translated by an interpreter.
