RESIDENT MAGISTRATE’S COURT.
This Day. (Before J. N. Watt, Esq., R.M.) Civil Cases. Smith v. Sinnaman, L2l 12s fid, for balance of account, with interest. Mr Stout for the plaintiff, Mr James Smith for the defendant. John Smith, the plaintiff, a farmer at East Taieri, said he supplied tne defendant with oats and chaff to the amount of LBO, on account of which he had received two payments—one of L3O and one of L2O. the goods were supplied in the year 1859, and interest was charged on the balance by mutual agreement. The defendant, a storekeeper in Ida Valley, bought oats of the plaintiff to the value of L7O, and he considered h j; paid the value of them. He never received any other account than tickets specifying the quantity. His intention was to pay about L 4, which he believed was somewhere near what was due, although he did not know the quantity taken by his man. Letters were produced admitting the balance. Judgment for the plaintiff, L2l I2s fid, with costs. _____________
