This was a claim for the price of clothes supplied. The plaintiff stated that tho goods were made to order, and that before they were sent home the defendant tried on the coat. The defendant objected to pay, on the ground that tho clothes were not made according to order, and that lie had not received them. He called Jacob Dickey, who was present when the orders ■were given, and who slated that he had seen tho clothes, which were nut made according to tho orders given. His Worship said it appeared to him that one article at least (the vest) was not made to order, if a tailor made a suit of clothes, and brought them home, and they did not tit properly when first tried on, it was not necessary to take the suit. Judgment for defendant.
