Tins Day. (Before A. C. Strode, Esq., R.M.) Civil Casks. Bird V. Thos. Weckes.—This was an appearance by the defendant, in answer to a fraud summons requiring him to say why a judgment of the Court was not satisfied. The defendant was ordered to pay the amount within ten days or to be imprisoned jlrp WPPkQ Hare, Pratt, & Co v. Clark.—L2o, the value of a bale of wool shipped at Invercargill, alleged to have been delivered short, in January last, by the steamer Samson. Mr Edward Cook for the defendant; Mr Holmes attended for the plaintiffs. This was evidence for the defence only, the plaintiffs having opened proceedings iu the ii M. Court, Invercarg 11. The case was simply that a certain number of bales of wool were taken on board the steamer for shipment by the May Queen, amongst which were G9 marked WM. Of ihe.-e 43 were delivered to the May Queen, and 2d brought up to Dunedin. One bale appears to have been lost, and the action was brought to recover the alleged value. Mr Clark, the owner of the Samson, 0. E. Houghton, the ship’s agent, Pilot L. P. St'-vcns, commander of her on the voyage, and John Watson, fjrstoflicer, were examined. The evidence showed that the arrangements were made at Invercargill.
